Terms of Service

01 Acceptance of Terms

By accessing or using Click Media Digital ("the Service"), you agree to be bound by these Terms of Service. If you're using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

If you do not agree to these terms, you must not access or use the Service.

02 Account Registration

To use Click Media Digital, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and not share it with third parties
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity occurring under your account

You must be at least 18 years old to create an account. One person or entity may not maintain more than one free account.

03 Acceptable Use

Click Media Digital is an email marketing platform. You may use it to send commercial email communications to individuals who have given you consent to receive such communications. You agree to:

• Comply with all applicable anti-spam laws including CAN-SPAM, CASL, and applicable EU regulations
• Only send emails to recipients who have opted in to receive communications from you
• Include a clear and functional unsubscribe mechanism in every email
• Honor opt-out requests within 10 business days
• Accurately represent yourself and your organization in all communications
• Maintain a sender reputation consistent with our deliverability standards

04 Prohibited Activities

The following activities are strictly prohibited and will result in immediate account suspension:

• Sending unsolicited bulk email (spam) of any kind
• Using purchased, scraped, or rented email lists
• Sending emails promoting illegal products, services, or activities
• Distributing malware, phishing content, or deceptive material
• Impersonating another person, organization, or brand
• Harvesting email addresses from websites without explicit consent
• Interfering with or disrupting the Service or its infrastructure
• Attempting to bypass account limits or access restrictions
• Reselling or sublicensing access to the Service without authorization

05 Intellectual Property

Click Media Digital and its licensors own all rights, title, and interest in the Service, including all software, designs, logos, and documentation. These terms do not grant you any rights to our intellectual property except as expressly stated.

You retain ownership of all content you create or upload to the Service, including email templates and subscriber data. You grant us a limited license to process and transmit this content solely to provide the Service.

06 Payment & Billing

• Paid plans are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by applicable law
• We reserve the right to change pricing with 30 days' notice
• Failure to pay may result in account suspension or termination
• You are responsible for all taxes applicable to your subscription
• Annual plan cancellations forfeit the remaining subscription period

For billing disputes, contact billing@clickmediadigital.com within 60 days of the charge.

07 Termination

You may cancel your account at any time through the account settings dashboard. We may suspend or terminate your account if:

• You violate these Terms of Service
• Your account engages in activity that damages our infrastructure or reputation
• We receive valid legal orders requiring us to do so
• You fail to pay applicable fees

Upon termination, your right to use the Service ceases immediately. We will provide 30 days to export your data for non-violation terminations.

08 Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We target 99.9% uptime but do not guarantee it.

09 Limitation of Liability

To the maximum extent permitted by applicable law, Click Media Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10 Governing Law

These terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer in the EU, you may also have rights under the laws of your country of residence.
